All sales made by Cool Plastic (a division of Desert Star Plastics (DSP)) are subject to the following Terms and Conditions. Prices, specifications, and offers are subject to change without notice.

1. Purchase of Goods & Services

• Ownership: All goods remain the property of Cool Plastic until payment is received in full.
• Late Payments: Interest may be charged on late payments in accordance with your credit agreement.
• Liability: By purchasing from our website, you agree to pay all invoiced charges. Failure to do so makes you liable for the full amount, including costs of collection, interest, and attorney’s fees.
• Accuracy: Cool Plastic is not responsible for typographical or photographic errors on the website.

2. Order Requirements & Payment

• Minimum Order: A $20.00 minimum is required for all orders. Orders under $20.00 will incur a $5.00 Low Order Fee.
• Payment Methods: We accept Visa, MasterCard, American Express, PayPal, and DSP Preferred Accounts.
• Checks: Pre-paid company or personal checks are accepted but require time to clear before production begins.

3. Shipping & Delivery

• F.O.B. Shipping Point: Risk of loss passes to the Buyer once the product is delivered to the carrier.
• Insurance: We insure shipments up to $100 per box. Additional insurance may be purchased by the Buyer.
• Processing Time: Standard stocked orders require 24–48 hours processing. Custom items or those requiring initial setup may take up to 3 weeks.
• Quantity Variance: On large or custom orders, a variation of +/- 5% in quantity is acceptable; payment adjustments will be made within 5 business days.

4. Returns & Inspection Policy

No returns will be accepted without proper authorization (RMA) and manager approval.

• Mandatory Inspection: Buyer must inspect all products for damage, defect, or shortage and notify Cool Plastic within 3 business days of receipt.
• Packaging Requirement: You must retain the original shipping package until the claim is resolved. If the original packaging is discarded, DSP reserves the right to refuse the claim.
• Non-Defective Returns: Approved returns on stock items are subject to a 15% restocking fee or $25.00, whichever is greater. Buyer pays all return shipping.
• Custom & Non-Standard Items: All custom-made items are non-returnable.
• Industry Tolerances: For simple fabrication, a registration variance of 1/16 of an inch is within industry standards and is considered acceptable unless precise tolerances were specified in the order.

5. Limited Warranty & Claims

• Warranty: Products conform to manufacturer specifications. Claims for defects must be made within 30 days of delivery.
• Resolution: DSP may, at its option, replace the product or refund the purchase price. Defective products will be replaced via Ground Shipping at DSP's expense.
• Exclusions: This warranty applies only to the original purchaser and does not cover misuse or improper care.

6. Limitation of Liability

Cool Plastic (DSP) shall not be liable for any indirect, incidental, or consequential damages—including loss of profits or business interruption. In no event shall our liability exceed the purchase price of the goods.

7. Governing Law

These terms are governed by the laws of the State of Arizona. Any legal proceedings shall be conducted in English and filed exclusively in the courts of Arizona.
