All sales are subject to the following Terms and Conditions. Price, specifications and terms of offers are subject to change without notice. Desert Star Plastics (DSP) is not responsible for typographical and/or photographic errors. All products are accompanied by the original Limited Warranty. Buyer pays return shipping charges for all RMA services. DSP reserves the right to refuse service to anyone.
Purchase of Goods and/or Services.
All goods remain the property of DSP until payment is received in full. Interest may be charged on late payments in accordance with credit agreement. If you purchase goods or services from our website, you agree to pay these charges when they are invoiced, billed, posted to your credit card or bank account. If you refuse or fail to do so, you are fully liable for such amounts and hereby authorize DSP to pursue you for collection of such amount including your full liability for all costs, interest, and attorney's fees for such collection.
Minimum Order Requirements
There is $20.00 minimum order requirement for all orders. Any order that is less the $20.00 will have a $5.00 Low Order Fee added to compensate for the disproportionate shipping and handling costs associated with small orders

We do not take C.O.D. orders. Please accept our apologies but we do not accept international credit cards on website at this time. Please call us at 1-800-878-6144 to place an order.
All delivery dates are only estimated, DSP cannot guarantee delivery on a specific date. DSP will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes. DSP will arrange for shipment of ordered products to the Buyer, Free On Board (F.O.B.) shipping point, meaning risk of loss passes to the Buyer upon delivery to the carrier. We insure shipment up to $100 per shipped box. Buyer can purchase additional insurance to cover potential damage or loss over $100 per box.
On orders with large quantities and custom made products, a variation of up to 5% in quantity is acceptable to Buyer. Payment adjustments will be made within 5 business days.
All orders require 24-48 hours processing time before shipping. DSP does not process orders during weekends and major holidays.
We use FedEx as our primary shipping company. However we reserve the right to select the shipping company of our choice. Estimated delivery time:
• Ground - 5 to 7 business days + 24-48 hours to process the order for stocked items.
• 3rd Day Air - 3 business days + 24-48 hours to process the order for stocked items.
• 2nd Day Air - 2 business days + 24-48 hours to process the order for stocked items.
• Next Day Air- Delivery within 1 business day + 24-48 hours to process the order for stock items.
• For all custom made items or items with initial setup, process time will increase up to 3 weeks.
DSP does not offer International shipping options from this website at the current time. Please call 1-800-878-6144 to place an order.
Orders for shipping outside of the 48 Continental States, also to APO/FPO and PO Boxes addresses, in most cases will require additional shipping charges with customer’s authorization.
All orders shipped outside of the 48 Continental states will be delivered by USPS Parcel Post, and delivery time will increase by approximately 1-5 weeks.
After shipment is received, Buyer shall inspect all products for damage, defect or shortage, and shall give DSP prompt notice, within 3 business days, of any damage, defects or shortage that buyer finds. Buyer shall retain shipping package until resolution of the case.
No returns will be accepted by DSP without proper authorization. Authorization and shipping instructions for the return of any product must be obtained from DSP. All returns are subject to manager’s approval.
Non defective products:
All returns are subject to a 15% restocking fee or $25.00, whichever is greater. Product must be returned with complete identification in accordance with DSP instructions or will not be accepted. Products must be in marketable condition upon receipt by DSP. Purchaser will pay for all shipping charges. For simple fabrication (not machined parts) registration variance of 1/16 of an inch is within industry standards and is considered acceptable. Registration variance may occur in plastic products unless precise tolerance is specified in the order. Custom made items and non-standard items are non-returnable. DSP will not be responsible in any event for product returned without proper authorization.
Buyer is responsible to inspect products upon receipt, and if defective Buyer, should retain the original shipping package and notify DSP within 3 working days. If Buyer does not possess the shipping package DSP reserves the right to refuse a claim. If the product is found to be defective DSP will replace at DSP expense via Ground Shipping service.
Products sold by DSP to Buyer conform to the manufacturers’ specifications as set forth in the applicable product certification. Buyer must give DSP a notice of any defects within 30 days after the date the products are delivered. DSP may, at DSP’s option, either replace the products or refund the purchase price. Buyer should not return products until DSP agrees that Buyer may do so. This Limited Warranty is given only to the original purchaser and does not extend to any subsequent purchaser or transferee of DSP’s products. The original purchaser is not entitled to extend or transfer this warranty to any other party. DSP is not responsible for improper use, any misuse, or inappropriate care of DSP products. Our stock items are labeled with a product code and DSP’s contact information. All claims must include the appropriate product code. Claims for damage, shortage, or any other reason must be made within 3 business days from the date of product receipt. Buyer must retain the original shipping package upon resolution of the claim. DSP will not be responsible for any harm arising out of Buyer’s purchase, possession or use of any products supplied by DSP, Buyer’s use of any function on DSP’s websites or any technical advice DSP may offer, except as agreed in the Limited Warranty set out above. DSP will not be liable for consequential, special, incidental or exemplary damages, including, but not limited to, loss of profits, cost of any substitute for the products Buyer bought, claims of third parties or injury to persons or property.
Limitation of Liability
You expressly understand and agree that DSP shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if DSP has been advised of the possibility of such damages), no matter how those damages were caused or arose. In no event will DSP be liable for any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of profits, business interruption, loss of programs or information, and the like) arising out of the use of or inability to use the service, or any information, or transactions provided on the service, or downloaded from the service, or any delay of such information or service (even if DSP or its authorized representatives have been advised of the possibility of such damages), or any claim attributable to errors, omissions, or other inaccuracies in the service and/or materials or information downloaded through the service. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
Governing Law and Jurisdiction
This site (coolplastic.com) is controlled by DSP from its office within the state of Arizona, United States of America. By accessing this site, which includes access to, or use of any of the site information and services, you and DSP agree that all matters relating to your access to, or use of, this site shall be governed by the statutes and laws of the State of Arizona, without regard to the conflicts of law's principles thereof. You and DSP also agree and hereby submit to the filing of any claim only in the exclusive personal jurisdiction and venue of the state of Arizona and any legal proceedings shall be conducted in English. DSP makes no representation that materials on this site are appropriate or available for use in other locations, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access this site from other locations do so at their own initiative and are responsible for compliance with local laws.
You agree that you shall comply with all applicable export and import control laws and regulations in your use of this site, or materials or services received through this site, and, in particular, you shall not export or re-export anything on or received through this site in violation of local or foreign export laws and/or without all required U.S. and foreign government licenses.
You agree to indemnify and hold harmless DSP, and its subsidiaries, affiliates, officers, agents, licensors, suppliers, co-branders, advertisers, or and other affiliated companies, and their employees, contractors, officers, agents and directors from all liabilities, claims, and expenses, including attorney's fees, that arise from your use of this site, or any services, information or products from this site, or any violation of these rules (including negligent or wrongful conduct) by you or any other person accessing this site
